Position Summary
The Equal Opportunity (EO) Investigator conducts prompt, fair, and impartial EO investigations into allegations of discrimination, harassment, retaliation, and other violations under a broad range of civil rights and equal employment opportunity laws. The investigator ensures compliance with applicable laws, organizational policies, and federal/state guidance while maintaining confidentiality, neutrality, and due process.
Key Responsibilities
Equal Opportunity Investigative Work - 80%
- Processes and assists individuals with the filing of EO complaints, informs them of the University’s process for responding to and otherwise handling complaints.
- Determine investigation scope, urgency, interim support, and any escalations or risk for potential protected activity.
- Communicates with all parties involved in an investigation, per UTEP policy, and as allowable by law.
- Ensure impartiality—identify and mitigate conflicts of interest.
- Demonstrates ability to handle complex situations, including responding to parties in a sensitive and informed manner.
- Tracks cases, meets case deadlines, and performs duties impartially and confidentially throughout the investigation process.
- Develop an investigation plan and timeline (e.g., witness list, interview sequencing, evidence collection, and interview logistics).
- Conducts prompt, thorough, fair and impartial investigations in accordance with Policy and law.
- Conduct trauma-informed, culturally sensitive, and legally compliant interviews with complainants, respondents, and witnesses. Maintains accurate, contemporaneous notes and records.
- Protects the integrity and privacy of the parties throughout the investigation.
- Gathers and analyzes documents that may include digital and physical evidence (e.g., emails, messages, chat logs, personnel files).
- Evaluate credibility, corroboration, and the totality of the evidence.
- Prepare high-quality, clear, objective written reports summarizing facts, analysis, and findings.
- Present findings to the Office of Human Resources or University leadership.
- Document case outcomes, close cases in the case management system, and coordinate with the Office of Human Resources or other University leadership for remedial measures (e.g., coaching, discipline, training, climate assessment).
- Exercises discretion and professional independent judgement regarding questions and concerns related to discrimination policies and processes.
- Assists with the preparation and interpretation of statistical data related to case investigations, complaints, grievances, and trends.
- Prepares, maintains, and reviews records pertaining to trainings, reports/complaints, investigations and other records.
- Recommend corrective actions including training, policy updates, or accessibility improvements.
- Evaluates and advises on potential risk exposure associated with complaints investigated.
- Maintains the highest degree of confidentiality in all sensitive information this position is privy to.
Training and Development - 10%
- Assist in the development and facilitation of EO training programs based on the current needs, or trends.
- Provides education that inform members of the campus community of their rights and responsibilities under state law and Policy.
Compliance and Policy Interpretation and Guidance -10%
- Provide advice and guidance to managers and employees on institutional EO policies.
- Collaborate and consult with the Office of Human Resources, Office of Legal Affairs, Title IX, and other internal partners to ensure coordinated responses to workplace issues.
Knowledge of all Microsoft Office software and able to learn and use institutional software systems.
Complies with all State and University policies.
Other duties may be assigned.
Qualifications

Required Qualifications
Education: Bachelor's degree in Human Resources, Business Administration or other related fields
and
Experience: Minimum of 2 (two) years of experience conducting workplace, Title VII/EEO, or employee relations investigations (or complex compliance/ethics investigations)
- Knowledge of employment laws, regulatory requirements and best practices.
- Excellent communication skills (written and verbal), organization, and attention to detail.
- Demonstrate ability to manage time sensitive and confidential information with discretion.
Preferred Qualifications
- Experience working in a higher education environment
- Bilingual proficiency (e.g., English/Spanish)
- Working knowledge of relevant federal and state civil rights laws, including ADA/ADAAA, Equal Pay Act, ADEA, GINA, Rehabilitation Act, VEVRAA, IRCA, Title VI, Title VII, and Texas Labor Code Chapter 21.
- Advanced HR certification such as SHRM-CP/SCP or PHR/SPHR
Working Conditions & Physical Requirements
- 40 hours per week, standard Monday- Friday 8:00am- 5:00pm, flexibility may be required when working on investigations.
- Some travel may be required.
- Must be able to handle confidential and emotionally sensitive information.
- Occasionally extended hours may be necessary to meet deadlines or address emergent issues.
- Prolonged periods of computer/desk work; ability to conduct in-person and virtual interviews.
- While performing the duties of this job, the employee must frequently stand and walk. The employee must regularly sit; use hands to feel; reach with hands and arms; and talk or hear. The employee must lift and move up to 20 pounds.
